Cell Phone Ban While Driving: HB 1247 (PA 98-506) – Holding your cell phone and talking will now be illegal state wide. Exemptions from the ban include the use of hands-free devices, two-way radios, and electronic devices capable of performing multiple functions as long as the devices are not used for a prohibited purpose. The first offense is not considered a “moving violation;” however, there are still penalties the offender will incur. According to 625 ILCS 5/12-610.2(c), “A person who violates this section shall be fined a maximum of $75 for a first offense, $100 for a second offense, $125 for a third offense, and $150 for a fourth or subsequent offense.”
