On Monday December 3rd a petition on behalf of the Stop the Mega Dump was filed with the Illinois Supreme Court. A decision by the Court regarding them taking the case should be handed down in January or in March.
“This is petition is on behalf of all the citizens of DeKalb County.” Said Dan Kenney, coordinator of the group, “In the time sense the Appellate Court handed down its decision in favor of Waste Management Inc. we have been encouraged by many residents to keep fighting the expansion.”
The final paragraph of the petition covers the core issue of “fundamental fairness”:
“A number of recent decisions involving landfill siting have affirmed the local decision and the Pollution Control Board in situations where serious fundamental fairness issues were raised. Peoria Disposal Company v. Illinois Pollution Control Board, 385 Ill. App. 3d 781 (3d Dist. 2008), Fox Moraine, LLC, v. United City of Yorkville, 2011 Ill. App (2d) 100017, 960 N.E. 2d 1144 (2d Dist. 2011). The trend observed in these cases is that pretty much anything goes during the landfill siting process in terms of improper communication of participants with decision makers. The fundamental fairness requirement has substantially eroded. The Court ought to accept review to reassert the minimal standards of fundamental fairness.”
“Again we urge the newly elected members of the DeKalb County Board to work together to find a better way for our County to handle its solid waste. We have time to reverse this path we are on that may lead to the worse environmental tragedy this County has ever experienced.” Kenney said.
